Article 1 – Definitions
The following definitions apply to these Terms and Conditions:
Withdrawal Period:
The time frame in which the customer may exercise their right to cancel the purchase.
Consumer:
A natural person not acting in the course of a trade or profession who enters into a distance contract with Elizabeth & Rose.
Continuous Contract:
A distance agreement relating to a series of products and/or services over time.
Right of Withdrawal:
The consumer’s right to cancel a distance contract within the stated withdrawal period.
Business:
Elizabeth & Rose – offering products to consumers via distance sales.
Distance Contract:
A contract concluded between the consumer and Elizabeth & Rose using online communication methods.
CESOP:
The EU’s Central Electronic System of Payment Information used to monitor payment service providers.

Article 3 – Scope of Application
These Terms apply to all offers, orders, and agreements between the consumer and Elizabeth & Rose.
Prior to concluding any agreement, these Terms will be made electronically available to the consumer.
Article 4 – Offers
All offers on the website are non-binding. Elizabeth & Rose reserves the right to modify prices, product availability, or content at any time.
Prices include the product price and, where stated, shipping costs.
Import duties, taxes, customs clearance fees, and courier surcharges are the responsibility of the customer unless explicitly stated otherwise.
Article 5 – Agreement
Once an order has been placed and payment has been confirmed, the agreement becomes binding.
From that moment onward, orders cannot be cancelled under any circumstances. Customers must wait until delivery before submitting a return request in accordance with Article 6 and 6a.
For clarity: cancellations are not possible after payment confirmation.

Article 6 – Right of Withdrawal
Consumers have the right to withdraw from their order within 14 days of receiving the product, without stating a reason.
Return shipping costs are the responsibility of the consumer.
Article 6a – Exclusions from Right of Withdrawal
Items discounted 40% or more are considered final sale and cannot be returned, refunded, or exchanged.
Items discounted less than 40% may be returned in accordance with our Return Policy.
Article 7 – Costs in Case of Withdrawal
Upon withdrawal, Elizabeth & Rose will refund the consumer within 14 days after receiving the returned item, provided it is in original condition and packaging.
For eligible returns, a $15 restocking fee per item applies to cover inspection and handling costs.
Article 8 – Customs and VAT
The consumer is responsible for all customs fees, import duties, taxes, and compliance with local regulations.
Elizabeth & Rose is not the importer of record for international shipments.
Any costs incurred during customs processing are the sole responsibility of the customer. Failure to comply with customs requirements is not grounds for cancellation or refund.
Article 9 – CESOP Compliance
In accordance with EU regulations, payment service providers may report transaction data to the CESOP system. Elizabeth & Rose complies with all applicable legal obligations.
Article 10 – Compliance and Warranty
All products are expected to meet the descriptions provided on the website.
If a product arrives defective or not as described, the customer must notify us in writing within 14 days of delivery. Returned items must be in original condition and packaging.
Article 11 – Delivery
Orders are normally delivered within 30 days.
If a delay occurs, the customer will be informed within 14 days after placing the order.
Elizabeth & Rose is not liable for customs delays or related costs. Failure to complete import procedures does not entitle the customer to cancellation or refund.
Article 12 – Complaint Resolution
Complaints must be submitted via email within 7 days of discovering the issue.
We aim to respond within 14 days. If additional time is required, the customer will be informed accordingly.
Article 13 – Disputes
These Terms are governed by the laws of the United States.
Any disputes will first be resolved through mutual consultation. If unresolved, disputes will be handled by the competent court in New York, USA.
Nothing in these Terms limits your statutory rights under applicable consumer protection laws.
